问：欧洲专利维持费的起始计算日期是不是其最早优先权日？

答：根据欧洲专利公约（EPC）第86条第1款规定如下：“Renewal fees for the European patent application shall be paid to the European Patent Office in accordance with the Implementing Regulations. These fees shall be due in respect of the third year and each subsequent year, calculated from the date of filing of the application. If a renewal fee is not paid in due time, the application shall be deemed to be withdrawn.”

因此，欧洲专利申请年费的缴费期限是从“申请日”（如果是国际申请的话，则为国际申请日）开始计算的，而不是优先权日或PCT申请进入欧洲地区的日期。从第三年起每年需要向欧专局缴纳年费，直到欧洲专利授权公告所在的那一年的年费被缴纳（A86(2) EPC），这些年费只向欧专局缴纳。之后的年费向欧洲专利生效的成员国缴纳（Art141(1) EPC）。
